Introduction
1.1 IMU Discounts is a subscription-based programme operated by Gorilla Tech Co. LLP. By subscribing to a plan under this programme (“IMU Discounts Plan”), users are entitled to exclusive discounts and benefits, which may be redeemed through the IMU Discounts mobile application (the “Platform”) in partnership with authorised vendors.
1.2 These subscription terms and conditions (the “Terms”) govern your access to and use of the IMU Discounts Plan.
Eligibility
2.1 The IMU Discounts Plan is open for subscription to all users who meet the registration requirements. Details for subscription are available via the “Subscribe Now” feature on the Platform or through specific invitations.
2.2 Corporate subscribers are advised to contact their respective organisations for eligibility and plan-specific information.
2.3 By subscribing, you acknowledge and agree to be legally bound by these Terms, which are accessible via the Platform and incorporated herein by reference.
Subscription Fees and Payment
3.1 Subscription fees (“Subscription Fee”) applicable to each plan shall be disclosed at the time of subscription.
3.2 Payment shall be made through:
- (a) Credit or debit card registered in your name; or
- (b) Any other payment method authorised by IMU Discounts (each a “Payment Method”).
3.3 Billing Cycle:
- (a) Monthly Plans: Billed every one (1) month from the subscription date.
- (b) Quarterly or Annual Plans: Billed upfront on the subscription date; the cycle corresponds to the plan duration.
3.4 Subscription will automatically renew at the end of each billing cycle unless cancelled in accordance with these Terms.
- Example: A subscription initiated on 5 July will renew on the 5th of the next applicable billing month or period.
3.5 By subscribing, you enter into an auto-renewal agreement, authorising IMU Discounts to charge your selected Payment Method at the end of each billing cycle unless you cancel your plan or modify your Payment Method.
3.6 It is your sole responsibility to ensure that your Payment Method remains valid and current. Failure to process payment due to insufficient funds, expired card details, or any other issue shall result in immediate cancellation of your subscription.
3.7 IMU Discounts shall not be held liable for any billing errors. In the event of a proven error caused by IMU Discounts, our sole obligation is to correct such error within a reasonable period upon notification.
3.8 You represent and warrant that you are legally authorised to use the Payment Method provided, and that such use does not violate any third-party rights.
3.9 Subscription Fees, once paid, are non-refundable under any circumstances.
3.10 IMU Discounts may offer temporary discounts or promotional pricing, which shall be valid only for the specified period. Upon expiry of such promotional period, the Subscription Fee shall revert to the prevailing rate. Cancellation must occur prior to renewal if you do not accept the revised pricing.
3.11 IMU Discounts reserves the right, at its sole discretion, to revise Subscription Fees at any time. Such revisions shall be communicated in advance and will take effect in the subsequent billing cycle unless otherwise stated.
Subscription Benefits
4.1 Benefits become available only upon successful payment of the Subscription Fee and compliance with the registration requirements.
4.2 Benefits are redeemable only through authorised vendors. Physical presence of the subscriber’s device and successful redemption via the Platform is mandatory to claim benefits, as per terms listed on the individual vouchers.
4.3 Subscriptions are non-transferable. Sharing of subscription benefits is strictly prohibited unless the subscriber adds a family member through the designated feature within the Platform, which may require an additional fee. The added family member gains access only to the primary subscriber’s vouchers, not to additional or separate vouchers.
4.4 The nature and extent of benefits shall be disclosed at the time of subscription and may be modified from time to time. Up-to-date information is available on the Platform.
Cancellation and Termination
5.1 You may cancel your subscription at any time via the unsubscribe option within your account settings. If assistance is required, please contact our customer support through the Platform.
5.2 Upon cancellation:
- Access to all vouchers and benefits for you and any added family member shall cease immediately.
- The auto-renewal will terminate at the end of the current billing cycle.
5.3 No refunds (partial or full) shall be provided for early cancellations.
5.4 IMU Discounts reserves the right to terminate any subscription at its sole discretion in cases of actual or suspected breach of these Terms.
Amendments
6.1 IMU Discounts may revise these Terms, including Subscription Fees and benefits, at any time at its sole discretion.
6.2 Changes will be communicated via the notification methods set out in Clause 7. Unless otherwise specified, such changes shall take effect four (4) weeks from the date of notification.
6.3 If you do not agree with the amendments, you must cancel your subscription prior to their effective date. Continued use of the IMU Discounts Plan shall constitute your acceptance of the revised Terms.
Notices
7.1 You agree to receive notices from IMU Discounts via any of the following means: registered email, SMS, push notifications, in-app messages, or any other contact information provided by you.
7.2 Notices shall be deemed delivered upon dispatch. If multiple notification methods are used, the earliest timestamp shall prevail.
Limitation of Liability
8.1 To the fullest extent permitted under applicable law, IMU Discounts, its affiliates, agents, and service providers shall not be liable for:
- Any indirect, consequential, or incidental losses (including loss of profits, revenue, data, or business opportunities);
- Any refusal by vendors to honour vouchers or discounts;
- Any acts, omissions, negligence, or misconduct by vendors or service providers (including food or service quality issues).
8.2 IMU Discounts acts solely as a facilitator connecting users with vendors and does not assume any responsibility for vendor conduct. Users waive all rights to raise claims against IMU Discounts for actions or omissions of vendors.
Use of Platform
9.1 These Terms are in addition to, and incorporate by reference, the general terms and conditions of the Platform, which are available within the IMU Discounts mobile application or on the website.
9.2 The App is not responsible for user interactions, follow activity, platform use, harassment, or misconduct. Users assume all risks and liability arising from communication or behavior on the platform.
Privacy Policy
10.1 Your personal data shall be collected, stored, and processed in accordance with our Privacy Policy, accessible via the Platform.
Governing Law and Dispute Resolution
11.1 These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan.
11.2 All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Lahore, Pakistan.
General Provisions
12.1 These Terms are binding solely between you and IMU Discounts and shall not confer any third-party rights, except for IMU Discounts’ affiliates and successors.
12.2 These Terms constitute the entire agreement between the parties, superseding any prior agreements, representations, or understandings, whether oral or written.
12.3 Rights and remedies under these Terms are cumulative and not exclusive of rights under applicable law.
12.4 Nothing herein shall be deemed to create a joint venture, partnership, or agency relationship between the parties.
12.5 You shall not assign or transfer any of your rights or obligations without prior written consent from IMU Discounts.
12.6 Failure or delay by IMU Discounts to enforce any provision of these Terms shall not constitute a waiver of that right.
12.7 If any provision of these Terms is held to be invalid, illegal, or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.
Language
13.1 In the event of any inconsistency between translations, the English version of these Terms shall prevail and shall be the legally binding version.
